Please help me! I need info about how long you have to move out when you sell an apartment after closing?
I really need help here
I’m a teenage male, living in NYC with my parents. My dad completely drained our finances, our apartment (that they own) was nearly foreclosed on, and to prevent that, they had to sell it. My mom is very much not savvy when it comes to things like this, and unfortunately, when it comes to housing law and such, I’m also rather ignorant. Our apt is worth nearly a million dollars and we’re ending up with like $150,000 after the bank takes everything. My dad doesn’t even have any intention of looking for work or doing anything, he just sees this as a get rich quick scheme and not to get into my personal emotions but it just seems like he couldn’t care less about my mom or I…he sold our health insurance, made no plans for our futures, I had to drop out of school because there’s no money for it so I’ve just been working two jobs.
Anyway, here’s the point of my question…my dad has proven himself to be a pathological liar time and time again. About a month ago, he found a woman to buy our apartment. She’s this awful awful woman – typical pampered Upper East Side bitch living off Daddy’s money. So for weeks my dad kept saying he was trying to find out the closing date for the sale and couldn’t get an answer from the lawyers. So then a few days ago, he says that the closing is Wednesday (as in tomorrow! Keep in mind I’ve lived here all my life and my parents have lived here 30 years. And this apt is really huge so we’re moving into one that’s 1/4 of the size.) and that’s the day we have to move out. So then he said he called them and we have until next Friday. Phew! Anyway, so then yesterday, he says oh guess what, we have to be out on Wednesday. I don’t know what I’m gonna do, I haven’t slept in two nights, I’ve just been packing everything, I feel like I’m about to collapse and we don’t have even half the stuff packed. This seems so wrong to me. Something just doesn’t add up and I feel like I’m being lied to. (Why couldn’t he get a closing date and then all of a sudden it’s one day before we’re supposed to leave?) Also, like I said I’m very ignorant when it comes to housing law, however I’ve always heard of when people sell their houses they get like 30 or 60 days between the closing and the date you have to move out. Like I said, the woman buying the place is a spoiled pampered bitch like you have no idea, and demands to move in tomorrow. I need to know what my rights are and quick because time is running out. Please please please please, if anyone can help me with this in helping me find out the truth. I’m still hopefully trying to push this thing back at least one day! Please, I can’t tell you how much I’d appreciate it. Thanks!

You were right. I started reading the contract and I AM being lied to! He said he didn’t know the closing date, he had no idea, he just told us yesterday! There on the front page of the contract “This contract is made as of Aug 11th 2009……The date scheduled for closing is on or about Oct. 1st”
So he’s now throwing a fit cause I caught him in a lie. Why would he lie about that though?? It seems like against his own interest. It makes no sense to me. I feel bad now for saying all the bad things I have about the woman buying the apt, cause she’s right! If we had known on Aug 11th that the closing was on or about Oct 1st, not only would we be completely ready but would be elated that we have an extra week!
Oh God, I don’t know what I’m gonna do. There’s nothing I can do though to buy more time right? I guess not
I’ve tried getting my own place but it’s very difficult. I don’t make enough money to able to sign for myself and my father won’t do it.

READ the contract.
Generally you have to be totally out, deliver possession, at time of closing. Different times can be specified in contract, and it is IN THERE.
Your mother had better get savvy NOW. If title to apartment is in her name as well as father’s, she had to sign contract, and she has to sign documents at closing. She should call attorney and say that it is impossible for her to close tomorrow. She should also request that proceeds from sale be put into two separate checks, and keep hers apart from Dad’s.

Once the papers are signed, the apartment belongs to the other person. Now sometimes there are agreements reached where the sellers stay in the home for a little longer, but agree to pay rent for the extra time that they are there. But there’s not guarantee that can happen. Either your father needs to delay signing the papers or you need to continue to pack. Sorry you’re in such a situation. Any chance you can strike out on your own soon? It doesn’t sound like such a happy family life where you are.

You must be out the day before the closing. No you do not get anytime.
