Is it possible to sue over this? An apartment being foreclosed?
Is it possible to sue over this? An apartment being foreclosed?
A friend was telling me today that he was moving into his grandparent’s house because his apartment was being foreclosed. It turns out that his mother had paid the landlord on time every month, but the landlord never paid the mortgage or something like that. They gave him nine months rent which was $900 a month, but now they have to leave. They found out because there was a notice on the door. The landlord never said a thing. They had to call the bank to get all the facts.
What can they do about this? Is it possible to sue? I understand we live in a sue-happy world, but for something like this, surely there’s got to be something, especially if they’re out over $8,000.
- Thanks.

Why are they out $8000? They lived there didn’t they? And no, you have no legal grounds to sue unless you paid rent in advance.

If they lived in the place for $8,000 worth of rent how are they out anything. They had no interest in the ownership of the property.

he could sue the landlord, not the bank. If the landlord is being foreclosed on, his next step may be bankruptcy. I don’t know if suing would do any good.
Why did he pay 9 months in advance? Sounds kinda shady to start with.

This sounds like this is all well within the lease. Every lease that I have ever seen has a cancellation clause, and it spells out what has to be done. Such as it has to be done 30 days in advance, and it has to be in writing, etc. It sounds like the notice to vacate has been done properly.
They are not out over $8,000. They got a place to live for 9 months in exchange for the $8,000, which is exactly what they were promised, and exactly wheat they signed for in the lease.
